Nature of Service
CartWay Logistics Limited (“CartWay”) is a logistics and delivery company providing door-to-door courier services for individuals and businesses. Services are conducted online via the company’s website, and CartWay does not operate any physical pickup locations.

The company’s services include local pickup and delivery, insured parcels, and scheduled delivery options. CartWay is authorized to expand its operations in the future to include broader logistics services, including but not limited to warehousing, supply chain management, and larger-scale distribution.

  • Open: Sunday to Friday, 6:00 AM – 8:00 PM

  • Sunday Hours: 6:00 AM – 12:00 PM

  • Closed: Saturdays and public holidays

1. User Data & Information

We do not store sensitive payment information such as credit card numbers. User data will not be shared with external third parties except as required by law. Internal promotional use may occur within our group of companies. Users may opt out at any time by using the unsubscribe link in emails.

In compliance with Anti-Money Laundering regulations, CartWay may request additional identification before completing a service. Payments must be made by the account holder unless prior written approval is granted for third-party payments.

 

2. Media & Content Rights

Photos or videos captured during delivery operations may be used for marketing purposes on our website or social platforms. Consent is assumed unless a user submits a written request to revoke it, including a screenshot reference, to our customer service email.

 

3. Addressing & Labeling

Customers must provide accurate shipment details, including their assigned CartWay shipping ID. Any incorrect or incomplete address information may result in a “bad address” fee. Vendors must use the exact address provided by the customer’s CartWay account.

 

4. Charges & Payments

Delivery Rates:
Calculated based on weight, delivery location, and service type (standard or express). A final quote will be provided before confirmation.

Processing Schedule:

  • Orders confirmed before 12:00 PM are eligible for same-day processing.

  • Orders confirmed after 12:00 PM will be processed the next business day.

  • No deliveries are made on Saturdays or public holidays.

Payment Policy:
All deliveries must be paid in full before dispatch. Accepted payment methods include debit/credit cards, bank transfers, and online payment platforms.

 

5. Modifications to Terms

CartWay may update these Terms at any time. Updated versions will be posted on our website and take effect immediately. Continued use of our services signifies acceptance of the changes.

 

6. Termination

We may suspend or terminate service if there is a breach of these Terms. Customers may discontinue service at any time. Packages in our possession at the time of termination will be handled in accordance with these Terms.

 

7. Shipping & Courier

CartWay manages the delivery of packages from the point of receipt to final delivery. All shipments are subject to inspection by relevant authorities. Any illegal or fraudulent use of our services will be reported to law enforcement. We fully cooperate with lawful investigations as required.

 

 

8. Restricted Items

It is the customer’s responsibility to ensure that shipped items are not prohibited or restricted under local laws. Restricted items may require import permits.

Examples of prohibited or restricted items include:

  • Checks, money orders, or financial instruments

  • Credit/debit cards

  • Occult materials (as defined by law)

  • Ammunition and explosives

  • Illegal or controlled substances

  • Hazardous chemicals, pressurized gas, or explosives

  • Temperature-sensitive or perishable goods (unless pre-approved)

9. Importation & Clearance

CartWay may assist with customs clearance when necessary. We do not accept liability for delays or detentions caused by missing permits, incorrect documentation, or customs procedures beyond our control.

 

10. Shipments

Delays:
If a shipment is delayed, customers will be notified via email, push notification, or through our online platform. Delays caused by carriers or authorities are outside our liability.

Detained Goods:
A shipment may be detained due to:

  • Incomplete or inaccurate invoices

  • Incorrect consignee details

  • Containing restricted or prohibited items

  • Permit requirements

Damaged Shipments:
If damage results from improper packaging by the sender, CartWay will notify the customer but accepts no liability. We do not process returns. If damage is caused by CartWay, an account credit will be issued for future services.

Incorrect Orders/Quantities:
CartWay is not responsible for supplier errors. Disputes must be resolved directly with the seller. Delivery charges remain applicable.

 

11. Late / No-Show Policy

Upon arrival, our courier will wait up to 15 minutes for delivery or pickup.

  • Late Fee: USD $3

  • 40 minutes: USD $6 capped at USD $9

  • No-show: USD $10

  • Redelivery Fee: Charged based on delivery zone

 

12. Storage

If delivery cannot be completed due to customer unavailability or incorrect information, storage fees apply.

Storage Policy:

  • Charges begin 2 calendar days after the first delivery attempt

  • Fee: USD $3/day per package (max 5 days)

  • After 5 days, packages may be disposed of at our discretion

 

13. Package Insurance

Packages in our possession are covered by insurance during transit.

Charges:

  • Minimum: USD $1.00 or 1% of declared value (whichever is greater)

  • Max coverage for undeclared value: USD $100.00

Excludes:

  • Improper packaging

  • Undeclared goods

  • Customs seizures

  • Sender error

 

14. Compliance

Customers must comply with all applicable laws. Any abusive, threatening, or unlawful behavior toward staff will result in immediate service suspension.

 

15. Limitation of Liability

CartWay is not liable for indirect, incidental, or consequential damage, including lost income or data. Liability is limited to the value of the delivery in question.

 

16. Force Majeure

We are not responsible for delays caused by events beyond our control, such as natural disasters, strikes, or government actions.

 

17. Indemnification

You agree to indemnify CartWay and its affiliates against any claims or losses resulting from your breach of these Terms or unlawful use of our services.

 

18. Governing Law

These Terms are governed by the laws of Jamaica. Disputes will be handled in the courts of Jamaica.

 

19. Agreement

By using CartWay’s services, you agree to these Terms and any updates published on our website.
